2. Purpose

These Terms and Conditions govern the use of the webfarus.com website and the contracting of the following services:

• Website Creation (traditional model)
• Professional Website Rental (with annual contract and management included)
• Digital Marketing (SEO, Google Ads, social media, email marketing)
• Graphic Design and Branding (logos, visual identity, promotional material)
• Custom Web and Mobile Application Development
• Strategic, SEO and Digital Marketing Consulting
• Production of laser-cut items (acrylic, MDF and other materials)
• Training in information technologies, digital marketing and artificial intelligence
• Sale of physical books and e-books

3. Acceptance

Use of the website and/or contracting any service implies full acceptance of these Terms and Conditions. Each service may be subject to additional specific conditions, to be included in the proposal or contract entered into with the client.

4. Delivery Times and Conditions

4.1. Delivery Times

• Professional Website Rental: 5 to 20 business days
• Website Creation: 4 to 6 weeks
• Online Store Creation: 6 to 8 weeks
• Books: 7 to 15 business days
• Laser cutting: 15 to 30 business days
• Software applications: to be defined per project
• Design, Branding and Marketing: according to proposal
• Training: according to schedule

Note: The indicated deadlines are averages and may vary depending on the volume of ongoing orders, project complexity and the availability of materials provided by the client.

4.2. Limitation of Liability

Webfarus is not responsible for delays resulting from force majeure or from non-compliance attributable to the client (e.g.: delay in delivering content or validations).

5. Client Obligations

• Provide all content (texts, images, access credentials) within the agreed deadlines
• Ensure that they hold the legal rights to the materials provided
• Review and approve the work in due time

6. Service Content

The services provided by Webfarus follow the conditions described here and may include additional specific clauses in commercial proposals or formal contracts. The main characteristics by service type are:

6.1. Professional Website Rental

Rules and Conditions for Professional Website Rental:

• Annual contract (12 months), automatically renewable unless otherwise communicated 30 days in advance
• The website is provided under a rental model: it remains the property of Webfarus throughout the contract term
• The client assumes full legal responsibility for the content provided, including texts, images, personal data or other elements incorporated into the site
• The client may use the site, images, texts and emails while the contract is active
• The client undertakes to use professional emails ethically and legally. Improper use may lead to service suspension to protect the digital reputation of the Webfarus infrastructure.
• Early cancellation implies payment of the full remaining annual amount due
• Includes domain (.pt or .com), hosting with SSL, professional email, technical support, maintenance and basic technical optimization (SEO)
• "All-inclusive" service with full management by Webfarus, with no technical knowledge required from the client
• Initial setup fee of €26.40, paid at the start of the contract
• Add-ons available according to the official price list (additional pages, forms, languages, online store, among others)
• The additional services (add-ons) available according to the official Webfarus price list are: extra pages, custom forms, additional languages, online store integration, advanced design, content creation, technical and local SEO, link building, connection to external platforms, among others.
• Digital marketing services (social media, ads, SEO management, email marketing, etc.) are not included in the rental and must be contracted separately.
• Webfarus may, whenever necessary, carry out mandatory technical updates to ensure the site's security, compatibility and performance, without requiring prior client approval.
• The structure, code and features of the supplied site may not be copied, replicated or transferred to other domains, even if they belong to the same client.
• Non-payment may lead to temporary suspension of the service, with the possibility of reactivation after regularization. If the outstanding amount is not settled within 15 days, Webfarus reserves the right to permanently cancel the contract.
• The resale, sublicensing or commercial reuse of the site or its content is expressly prohibited without prior written authorization from Webfarus.
• The site footer may include the signature "Powered by Webfarus", unless otherwise contractually indicated
• In the event of a dispute or non-compliance, the site may be taken offline without prior notice, with Webfarus reserving the right to remove the content and block access until the contractual situation is regularized

6.2. Website Creation

Rules and Conditions for Professional Website Creation:

• Payment divided into two stages: 50% upon award and 50% upon final delivery
• Online publication and transfer of ownership only after successful collection of all outstanding amounts
• If the final payment is not made within the agreed deadline, Webfarus reserves the right to suspend the project, retain any delivery and disable access to the content until successful payment collection
• The project must be completed within a maximum period of 3 months after award. After this period, it will be considered completed, unless there is a justified reason agreed in writing
• After delivery, the client has 30 days to review the site and send all requested corrections by email in a single document
• Failure to deliver the change document within the stipulated deadline will be considered full, final and irrevocable acceptance of the delivered work
• If the client publishes the site or starts using it before sending the correction document, this will be considered tacit and final acceptance of the delivered work
• Fragmented, oral or dispersed communications will not be considered valid (e.g.: separate messages, screenshots or calls). Corrections must appear exclusively in a single document sent by email
• Webfarus has up to 30 days to apply the requested corrections, unless otherwise contractually indicated
• Corrections include only adjustments resulting from technical failures by Webfarus in implementing the approved project. They do not include changes to features, structure, content, images, styles, colors or other elements not specified in the initial request
• The service provided corresponds to the number of hours contracted in the initial quote. Any changes outside that scope require a new quote and written approval
• The client may not demand successive revisions or request new features, design changes, structure changes, texts or images that have not been previously agreed or quoted
• In the event of cancellation by the client after award, the initial amount paid (50%) will not be refunded, as it covers technical time already invested, domain acquisition, hosting, planning, meetings, analysis and other operational costs
• The client undertakes to provide all necessary materials in good time. Webfarus cannot be held responsible for delays caused by non-compliance or successive changes by the client
• Webfarus reserves the right to include the project in its portfolio and communication materials, unless otherwise contractually indicated
• Webfarus is not responsible for changes, failures or problems resulting from external interventions on the site after final delivery

6.3. Digital Marketing

Includes services such as SEO (on-page and off-page), Google Ads, social media management, Google My Business and other associated services.

• All services are provided through a formal proposal, with clear definition of objectives, channels to be used, frequency and minimum contract duration (usually six-monthly or annual)
• The start of campaigns is conditional on initial payment and timely delivery of all necessary materials by the client (e.g.: access credentials, images, business information)
• Campaigns and strategies are developed based on best practices and technical know-how, but do not guarantee specific results (e.g.: Google positions, number of followers, sales or contacts)
• The client undertakes not to interfere directly with advertising accounts or platforms managed by Webfarus (e.g.: Google Ads, Meta, etc.) without prior coordination. Any unauthorized changes void contractual responsibility
• The client may suggest changes to the monthly plan, provided they are previously agreed and compatible with the number of contracted hours
• Performance reports are provided monthly, unless another frequency is contractually defined
• Webfarus reserves the right to suspend campaigns in the event of non-payment, lack of response or relevant communication failure by the client
• Cancellation must be communicated at least 30 days in advance. There is no refund for current monthly fees or services already performed
• Early cancellation by the client implies payment of 30% of the remaining amount until the end of the current contract (six-monthly or annual), unless otherwise agreed in writing
• Access credentials, campaigns, accounts and technical configurations created by Webfarus are company property, unless otherwise contractually stipulated
• Advertising investment budgets (Google Ads, Meta, etc.) are contractually defined and may be paid directly by the client to the platforms or in advance to Webfarus, as agreed
• Initial setup services, when applicable, are charged separately and are non-refundable after work begins
• The client may not demand refunds, unlimited revisions or changes outside the contracted plan without a new approved quote
• Silence or prolonged absence by the client (more than 15 business days without response) may lead to service suspension, without suspension of due payments

6.4. Strategic, SEO and Marketing Consulting

Consulting and auditing services for strategic support in SEO, digital marketing and online positioning, including analyses, diagnoses, plans, recommendations and technical follow-up.

• Services are provided through a formal proposal or contract, with clear definition of scope, objectives, deliverables and deadlines
• The start of consulting is conditional on initial payment and timely provision of all data, access credentials and information requested by Webfarus
• Consulting and audits are advisory in nature and do not guarantee concrete results, as they depend on external factors and implementation by the client
• The client undertakes to collaborate actively, provide truthful information and implement technical recommendations under their own responsibility
• Changes to the scope or additional requests will be subject to a new quote and written approval
• The reports, plans and diagnoses delivered are intellectual property of Webfarus and may be used for internal purposes, portfolio or benchmarking, unless otherwise agreed
• The client must respect the confidentiality of the documents received and not disclose them without authorization
• The contract may provide for monthly or one-off follow-up; cancellations must be communicated 30 days in advance, with no right to a refund for services already performed
• In the event of non-compliance by the client, namely delay in providing data or payment, Webfarus reserves the right to suspend the work until regularization
• Webfarus' responsibility is limited to providing the agreed recommendations and analyses, not including their execution or implementation, unless contracted separately

6.5. Training

In-person or online training services in information technologies, digital marketing, artificial intelligence and related areas, with clear pedagogical objectives and an adapted methodology.

• Registration for training is only valid after payment confirmation and receipt of the necessary documentation
• The client/trainee undertakes to participate in the scheduled sessions, respecting the times and rules defined by Webfarus
• Cancellations requested up to 5 days before the training start date are fully refundable
• Cancellations with less than 5 days' notice or unjustified absences do not entitle the client to a refund
• Webfarus reserves the right to postpone or cancel sessions for technical or unforeseen reasons, giving as much notice as possible and ensuring rescheduling
• The educational material provided is protected by copyright and may not be reproduced, distributed or shared without authorization
• Session recordings, when made, are the property of Webfarus and may not be disclosed without prior consent
• It is the trainee's responsibility to ensure suitable technical conditions for participation in online sessions (connection, equipment, software)
• In the event of non-payment, Webfarus may suspend access to the training until regularization
• Any request for adaptation, date change or refund outside these conditions must be analyzed case by case and depends on prior approval

6.6. Laser Production

Production services for customized items with laser cutting and engraving in MDF and other materials, provided by Luferr, a business brand associated with Webfarus.

• Orders and specific production, delivery, payment, cancellation and return conditions are detailed in the Terms and Conditions available at luferr.com/termos-e-condicoes
• Webfarus acts as representative entity and guarantees compliance with the agreements established by Luferr, according to applicable legislation
• As this is a personalized service, returns or cancellations are not accepted after production begins, unless otherwise provided in Luferr's terms

6.7. Sale of Books and E-books

Sale of physical books and e-books produced by Webfarus, with clear conditions for delivery, returns and buyer rights.

• Physical books are sent to the address indicated by the client, with estimated delivery times as informed at loja.webfarus.com
• E-books are made available for immediate download after payment confirmation and cannot be returned due to the digital nature of the product
• The client has the right to cancel the purchase of physical books within the legal period of 14 days, provided the product is in perfect condition and in its original packaging
• Returns of physical books must be communicated in advance by email and follow the instructions indicated by Webfarus
• Return costs are the responsibility of the client, except when the return results from a Webfarus error or defective product
• Webfarus is not responsible for delivery delays caused by carriers or incorrect information provided by the client
• The copyright of the content of books and e-books is reserved to Webfarus, and total or partial reproduction without prior authorization is prohibited

7. Liability, Intellectual Property and Data Protection

• Webfarus reserves the right to modify the contents of the website without prior notice.
• All content, including texts, images and logos, is the property of Webfarus and is protected by copyright legislation.
• Users' personal data is processed in accordance with the General Data Protection Regulation (GDPR).

8. Dispute Resolution, Applicable Law and Jurisdiction

• In the event of a dispute, the consumer may contact the Algarve Consumer Conflict Arbitration Center. More information here (ADR).
• Portuguese law applies, and the court of the district of Faro has jurisdiction to resolve any matters arising from these Terms and Conditions.
